The 1st Annual PMLF Tailgate Party & Chili Cook-Off was a huge success last night! We had an amazing turnout, with everyone bringing their A-game for the chili competition. The atmosphere was electric with live music, great food, and plenty of tailgate fun. Congratulations to all the chili chefs, especially our grand champion. Dave Larson! Thanks to everyone who came out to make this event unforgettable - we can't wait to do it all again next year!

PMLF Fundraiser 2024

Thank you to all who attended this ceremony. Particular thanks go out to Cheryl Glenn who came from PA Rep. Tara Probst Office, Ed Hammond Military Veteran, Sally Foley, who shared the story about the POW flag, and to Jenny Martinez PMLF Recreation Chair for organizing this event. It was a great success.
We want to thank all our military for your service and especially on this Memorial Day we remember those who sacrificed their lives for us to live free today. God Bless America!

Message to the Residents

Dear Neighbor:

On behalf of the Board, I would like to extend warm greetings to all residents of PMLF as we approach the holiday season. This was a year of transition for many of us as we attempted to return to a new normal. Many of the projects we scheduled in 2023 were completed: all roads planned for improvement finished, the facade and interior of your clubhouse revitalized, purchased and/or made improvements to our community and are pleased that our part time maintenance worker is on board and doing much of what our volunteers were doing. The BOD will continue to earmark as much money as possible towards road improvements since all consider this a priority.

As we continue to make improvements to our community both in safety and aesthetics we've done so with fiscal discipline in an attempt to not raise HOA dues for our residents keeping next year's fiscal budget the same as this year's budget. The Board will continue to work towards those goals all of us envision for PMLF.

Cancellation Notice of December 17th BOD meeting The Board has canceled the regularly scheduled BOD meeting of December 17th, 2023. All business previously scheduled on this agenda has been carried to the next regular meeting of the Board of January 21, 2024 @ 11AM in the Clubhouse.

December 9th The Beautification Committee will be decorating the clubhouse interior and our three gates. Please if able, set aside some time to come down and help these volunteers. Start time is 9 am at the clubhouse.

December 16th from 6pm to 10pm PMLF's PotLuck Community Holiday Party. Last one held was a great success bringing out over 50 of our residents. All had a fun time and the variety of meals and desserts were first class delicious.

To add to the festivity, there will be an Ugly Sweater Contest. Whether it be sparkles, and shimmers, contrasting colors and themes, wear your wildest patterns and come and be seen at our Ugly Christmas Sweater contest. A prize will be awarded. Join us for an unforgettable night of fun and friendship. Confirm your attendance to: Recreation@pmlfcommunity.com.

Cookie Swap A chance for you to make your favorite cookie and swap for other's favorite cookies. No better way to have a plate of delicious different cookies than to do a cookie swap. If you are interested, email immediately the cookie you are making to: Recreation@pmlfcommunity.com. Once we have a complete listing, the date and amount of cookies needed for the cookie swap will be set. If enough residents are interested, the cookie swap would be the week before Christmas either at 7pm one night or early Saturday morning on December 23rd. The amount of cookies needed for swap depends on the number of residents participating, so send in your response quickly.

Holiday Decorating Contest If you are decorating your homes and front lawns with holiday decor/lights and are interested in being considered for the Holiday Decorating Contest, send your name/address to the Board to: Recreation@pmlfcommunity.com. Volunteers from the Beautification and Events committee will visit these homes and select the house that most represents the holiday spirit. A $25 gift certificate will be awarded so let your creativity shine.

Special Recognition This community is moving forward and recognition goes to all of our many volunteers that are on the Road & Maintenance Committee, Beautification, Governing Docs, Finance and ITT. To all of these residents that have worked endlessly towards promoting and making change, you are so appreciated! So again ... thank you ALL. You are instrumental in making the differences we see happening in our community

Dear Residents,
The Halloween event planned for October 28th has been cancelled since Akenac and several other sites are hosting Halloween parties so turnout was low in our community. Next year we hope to host a Halloween Party for our youth inside the clubhouse. We may try and plan a holiday event, and will keep you apprised.

June 15th, 2023 Bulletin

Dear Members,
On Saturday June 10th, resident volunteers and the PMLF Roads/Maintenance and Beautification Committee teamed up to work together. Dead trees were pulled up, potholes were filled in at the Gate 1 mailboxes/school bus turnaround, decking was repaired and replaced at the Clubhouse and flowers were planted at both the Clubhouse and the Gate 1 entrance. Thanks go out to all the volunteers who came out to share their free time with us and to make our community a better place to live. It is great appreciated. At Sunday's BOD June meeting, contracts for road work were finalized. Summary of the work to be performed is provided in our portal in the documents section and also available in the link below. The board is reviewing contracts for additional road work. Dues are essential to getting more work completed. If you have not paid or would like to get on a payment plan, please contact us. Those of you that have already entered into a payment plan please make sure you are up to date on your payments.

We desperately need volunteers for our grievance committee. Some have expressed that they would like to assist with PMLF but are unable to do some of the physical volunteer work. This is your opportunity to serve your community. Please email us at office@pmlfcommunity.com if you would like to join this committee.

Lastly, the board would like to invite members in good standing to a potluck at the clubhouse on July 8th. Please RSVP to office@pmlfcommunity.com if you are interested in attending. Our last potluck was quite successful, and a good time had by all!

April 17th, 2023 Bulletin

Dear Members,
The board of directors, at their most recent meeting, discussed the status of the pool. We are sad to announce that the pool is not in a condition to be used and will remain closed for this season. We are working to have the road to the lake inspected by the road committee and a proposal shared to the board to have this access road repaired. This will allow members to have an easier time getting to the lake. This season, the board will continue to work on having the pool assessed and get a better understanding of what work needs to be done and the costs associated with getting it running again. Some work has already taken place at the pump house to make necessary electrical repairs.

It is also the board's pleasure to announce that additional road work was approved at the meeting. All the hard work to pursue back dues owed to this community has allowed the board to encumber close to $140,000 in road work. This work will be in addition to any future work taking place for the upcoming fiscal year. Our budget for 2023 has $175,000 allocated for road work and if dues payments continue to be made, we will be able to get significant additional work done. All the work discussed at the meeting is outlined in the Schedule A document located on Tops under the Roads folder. Also a reminder that the Beautification's Clean-up Weekend will take place this Saturday and Sunday. Meet at the clubhouse at 11 am.

We look forward to seeing everyone at the May GMM where an important vote regarding your by-laws will take place. This vote can only be done in person by members in good standing so please plan to be there.

At the board meeting held on March 19th, there was an announcement for volunteers needed for the following events:

As of this moment Flower Power has raised $356. We will be fundraising until May 15. Residents are more than welcome to donate directly to the Beautification Team and not have to purchase flowers. Beautification Committee Fundraiser

Dear Residents,
The PMLF Beautification Committee needs help to start up and maintain our garden and to help improve our community grounds in all three Gates. So we started this Fundraiser called FLOWER POWER. You can purchase bulbs, flowers, and other green items for your gardens from the catalog. All purchases are sent directly to your homes and are guaranteed by the company. The Fundraiser is only good until May 15.

We will use money from our fundraiser to purchase plants, seeds, soil and soil supplements, and garden accessories. In addition to these yearly expenses, we need to purchase items to support our other environmental initiatives such as community clean-ups, grounds projects and other special events. Weather and Community Event

Dear Members,

We will be experiencing inclement weather from snow, rain and a hard freeze over the next 2 days. Our contractor is preparing for this event and will be out treating the roads as necessary. As always if there are any problem areas please contact us so we can get them addressed.

At the last board meeting, several residents expressed interest for a get together. Click on this link to the flyer for an upcoming potluck gathering for January 7th. We hope to see many new and old faces for a fun evening with neighbors.

Lastly, the community was represented at the Pike County Magistrate Court yesterday regarding our first batch of civil complaints for non payment of dues. We are happy to report that we were successful in judgements for all of them. Therefore we encourage members to address their outstanding debts to the community. We will be working on our next batch of complaints and expect to have them filed shortly after the new year. If you would like to avoid additional court fees or any type of judgement against you please contact us to get this addressed. We are still accepting payment plans but our fiscal year is coming to a close in a few short months.

Holiday Decorating


Hello Members!

The beautification committee will be meeting on December 10th at 10:30 am at the clubhouse to decorate the clubhouse and other areas at all 3 gates. We are hoping residents will attend and volunteer to assist the committee. Rain date will be December 11th.

November BOD meeting agenda

Road work - Drainage Swales


Dear Members,

As an update regarding the road work, McConnell Construction is working on the last phase of the approved road work for the fiscal year. Work on Seneca Trail in Gate 3, from the entrance to the area of previous repairs, is underway. All other work in Gates 1 and 2 are complete and will be monitored through the winter season. The board will be reviewing the next round of planned road work as we approach spring and what roads are next priority needing attention. Our new budget, which goes into effect May 1st, provides additional monies for repairs and we are hopeful much more work can be done than what was achieved thus far. Many thanks to McConnell Construction for working with the community to get this done.

On another note, we ask all residents to please pay special attention to their culverts and drainage swales along their property. Please make sure all leaves and debris are removed from these areas. Clearing the areas on each side of your culverts are important but many neglect to clean out drainage swales as well. McConnell Construction has cleared many of the swales along the stretches of roads where his repairs are done but we need residents clean these out where road work may have not happened yet on their properties. The board along with the maintenance committee volunteers will be taking a closer look to ensure residents are doing their part on maintenance. Without proper drainage our road repairs are not sustainable.

End of the Season Volunteer Work


Attention PMLF Residents,

Please join the Board and the Road/maintenance Committee this Sunday morning (10/30) at 8:30 am at the clubhouse in Gate 1 for some end of the season volunteer work. We'll be performing the following tasks:

  • Doing inventory in the buildings around the clubhouse
  • Cleaning up the area
  • Doing some maintenance and light construction to the property and common areas

The key to turning this community around is resident involvement. Please come to lend a hand if you can and show your support, or just stop by to connect with other community members and some of the volunteers that have been driving the recovery of PMLF.

Road Work Announcement


Fellow residents,
The Board and the Road/Maintenance committee would like to make everyone aware of the following projects which were approved at the general membership meeting on Sunday 8/21, and that will be taking place over the course of the next few weeks. The Board is dedicated to transparency and using whatever funds are collected to put back into the community to benefit all residents:

  • FOX ROAD, Gate 2: Eclipse Asphalt is scheduled to return on September 6th to finish filling potholes and damaged areas on the remaining stretch of Fox up to Weasel. They will also be going over work already done to supplement/correct problem areas along the entire stretch of Fox with up to 10 tons of hot asphalt at no additional cost to the community. Please try and stay safe as you travel along any stretch where crews are working, and remember keeping speed down in general along Fox road will help to make the repairs last longer.
  • SENECA ROAD, Gate 3: McConnell Construction has been hired to repair the hazardous stretch along Seneca between 120 and 131 Seneca Road, along the steep curve which is particularly dangerous during winter. All drainage will be re-established, trees will be cut back to improve visibility, debris will be cleared, and the road will be completely rebuilt from the base up. Morris Asphalt has been hired to apply 2 coats of Tar/Chip to seal the surface. Appropriate signage will be posted to encourage responsible driving along this area. The road will be under construction one side at a time but your cooperation as you travel through this area will be necessary to keep things safe and to expedite the work. Work should begin Wednesday, August 31st.
  • ENTRANCE to Gate 1: Eclipse will be hired to repair and overlay the bridge into Gate 1 with hot asphalt. There are areas on that section where the road surface has worn down to rebar, and it needs to be addressed sooner than later. Estimated time for this project should be on or about September 6th. The bridge will be repaired one side at a time so as to not disrupt the flow of traffic. Please be patient, safe, and courteous as the construction is taking place.
  • LAKE FOREST, Gate 2: Morris Asphalt has been hired to rebuild Lake Forest from Silver Lake to the bus stop. A leveling course will be applied and compacted, and two coats or tar/chip will be applied to seal and protect the road and facilitate drainage. Once construction is completed, which will hopefully be by the end of this week, the bus company will send an inspector down to verify that school bus service can be reestablished at the bus stop area no more craziness at the Gate, your kids will be able to get on and off the buses safely again at the bus stop on Lake Forest near the mailboxes.
  • Support for Secondary Community Roads: Modified stone deposits will be maintained in all 3 gates, and are available for residents to use if they choose. Road Committee volunteers will continue to provide pothole fill when possible. Requests for committee assistance should be sent to roads@pmlfcommunity.com

Please note that dates and job duration for these projects could vary based on the weather. As noted earlier, please be respectful and considerate as you pass road crews.

As always, best practice for concerned residents who want to know what's being done to move our community forward:

  1. Come to meetings - it's always the same 20 people out of the entire community who attend. Don't be afraid to come, it isn't as it once was. It's an open forum dedicated to informing and involving residents about plans for our community. Please come ready to be civil and in the spirit of cooperation.

CANCELLED 50th Celebration


Dear Residents,
It is with great regret that the board has decided to cancel the 50th Anniversary Celebration party for September. It seems there is still much healing that needs to happen within our community and with lack of attendance it didn't make sense to move forward with the event. This once was a beautiful community and we believe it can be a beautiful community again with the few great volunteers that are working so hard. We appreciate all that has been done in such a short time. Our hope is that a celebration can be had in the future. Thank you

In order to try and get remedies on ATV's, dirt bikes, etc., we met with Rangers from the PA Department of Conservation and Natural Resources for assistance in bringing these violators into compliance. We are pleased to announce they will assist us in this endeavor. Please take photos of the offending all terrain vehicles and forward them to the Board at office@pmlfcommunity.com as part of our Neighborhood Watch program. In turn the Board will then forward all the photos to Ranger Thompson who then has the ability to assist in enforcing these violators. We will continue to work towards solutions that mitigate your quality of life.

Road Maintenance Update

Dear Residents and Property Owners,
The board would like to provide a quick update prior to our monthly June BOD meeting next weekend. We have entered into a contract for pothole filling only for Myers Drive in Gate 1, from the clubhouse to Willow Dell, and Fox Road in Gate 2 from the gate to the cul-de-sac. The repairs will consist of holes being cleaned, tack oil applied at the bottom and hot asphalt installed and compacted. All repairs will be seamed with joint sealant. Our contractor is expected to start work on July 5th weather permitting. We ask that you provide them the courtesy of driving responsibly in work zones. The cost for Myers is $16,886 and Fox is $57,134. At this time no other work can take place due to the lack of dues payments. The board and the road committee have been working together to gather quotes and strategize road repairs whether temporary or permanent. Unfortunately, we cannot engage these contracts unless dues collection improves. A full breakdown of financials will be discussed at the June BOD meeting on the 19th at 11 am at the clubhouse. If you cannot attend, meeting minutes, when adopted, will be posted in the Tops portal.

To ensure the safety of our children, please park your car in the Maintenance Building/Pool parking lot area. There should be NO parking of cars along the tennis court side of the parking lot during bus pick up/drop off. This will prevent children from running across the roadway to get to and from the bus. Road Maintenance - Gate 2, 4/22 Complete

Fellow PMLF residents,

The Road/Maintenance Committee has completed the road maintenance on Lake Forest Drive. This will be one of many projects to come.

The community has already purchased a stone mix which when combined with a chemical bonding agent creates a very durable material to use that should last until we can make our way to more permanent solutions, which is of course our priority.

We have the machines and the tools, but can use additional help with the labor. We're asking for volunteers to join us to help make the most of the day. The more help we can get, the more we can get done. The Committee and the Board want you to see we're moving forward to get this community back on its feet, and are hoping that the membership will take this and any other opportunity that comes up to join the effort.

Here are some of the things you can bring with you if you can volunteer:

  • Heavy duty push brooms
  • Tampers
  • Blowers
  • Shovels
  • Empty 5 gallon buckets
  • Water
  • Food?
If you're planning on helping out, bring whatever PPE you feel you'll need (work gloves, goggles, masks, etc).

We need to become a community again to make this work. We're hoping to meet more of our neighbors this Spring.

Gate 2 Road Maintenance Update

Hello again fellow residents,

The Road/Maintenance Committee had 3 loads of modified fill delivered to the bus stop area in Gate 2 for the pothole repair work we have scheduled for this weekend. Again, this will depend on the weather and unfortunately the forecast is still not favorable. We'll be sure to keep everyone updated as the weekend approaches, and are going to ask that in the meantime, residents not take any of the material for themselves. We're going to be making the most of it with the chemical bonding agent and roller compactor, so would rather people not attempt using it in common areas on their own.

Here's hoping for a nice stretch of weather so we can get to work!

Scheduled Maintenance (Tree Work)

Good afternoon,
Treesmith utility arborists representative has a message for the residents of Pocono Mountain Lake Forest:
Treesmith utility arborists, will be conducting routine maintenance trimming on behalf of Met-Ed, approximately starting this March. Treesmith will be performing vegetation clearance along the power line right of way, to ensure safe and reliable electric for met-Ed customers, to help prevent service interruptions. This work will be performed at no expense to you. Routine maintenance involves trimming of live, healthy, mature trees to obtain proper clearance to power lines, as well as, addressing hazards along the utility. The trees deemed hazards will be tagged with blue ribbon and removed, debris will be chipped and large wood remains on site. Tall brush (Saplings up to 10 inch) along or under the utility will be removed, as well. Where removals take place, herbicide application will be disbursed for stump regrowth treatment. The herbicide is an oil base garlon, direct spray, that lasts in ground approximately 45 days. Service drops (pole to house) are not included in routine maintenance, unless pressure or hindrance is obstructing service wire, pressure will then be removed.

NOTICE ON DUES COLLECTION

Collecting dues at clubhouse on Saturday, February 12th from 10am-12pm

Dear Resident,

We realize many of you are tired of the deceit, litigation, fines, and have loss of faith, and doubt in leadership but you all voiced your feelings clearly in this past election wanting PMLF to flourish and return to the pristine community all moved here for. In order to rebuild the trust of the community, to further our goals of transparency and restore financial stability in our community, the BOD will use the last adopted budget of the community from fiscal year 2018/2019 for billing of dues. Please note that the board is working to review documentation provided by the previous administration therefore it will take some time to produce invoices for each member. The history of dues since 2018/2019 follows and will aid in explaining the three-year dues billing. Until such time that actual invoices can be generated and sent, we are asking members to step forward with payments so that the community can begin to heal and tackle the maintenance issues we are facing.

2018-2019 - Prior administration sent dues invoice for $602: This is the first year at $602 for a house with a lot. The following breakdown is what has been posted in the clubhouse based on this last adopted budget vote:

Lot with Home: $602.00
Home with Tenant: $918.00
Unimproved Lot: $691.00
Adjoining Lot: $326.00
Unbuildable Lot: $292.00

2019-2020 - Both Floss et al and the IBOD sent out invoices this year. Some residents paid the IBOD and some paid Floss et al. The forthcoming invoice DOES NOT include the dues for this fiscal year. If you owe dues from this year, you are still responsible for payment. If in arrears, when all accounts are up to date, billings on arrears will be sent in a separate mailing to those that are delinquent on any dues owed to the community. The following years represent the upcoming total invoice amount which will be sent in immediate future.

2020-2021 - No invoices were sent to the community members. Dues will be set at the amounts listed above since there was no adopted budget in place due to pending litigation. By-laws call to use the previous years budget.

2021-2022 - No invoices sent to the community members due to pending litigation. Dues would be as listed above. By-laws call to use the previous years budget.

2022-2023 - These dues are for the upcoming fiscal year are as listed above. Typically, this billing would be sent in April but we are including them at this time to simplify the invoices and keep mailing costs down due to limited funds.

Your Finance Committee is beginning work on the budget for FY2023-2024 to be voted on at the Fall GMM and will be billed in April 2023. Be aware come October at the Fall GMM when an election for a new BOD and a new budget, members will need to be in good standing in order to participate in the vote.

PAYMENT DUE DATE:

Payment is due is within 30 days of the actual invoice date. This will be identified on the invoices once they are generated and sent. DUES PAID OFF WITHIN 30 DAYS RECEIVE 10% DISCOUNT. The discount will be applied to those paying either 2 or 3 years at once. Discount on previously paid dues does not apply.

If you wish to pay your dues, we will be at the Clubhouse this Saturday February 12th from 10am-12pm to collect dues. Future dates for collection will be announced when scheduled. If you paid prior administration (Floss or IBOD) for any prior years, supply evidence of payment (cancelled check and/or receipt reflecting year/amount paid).

Any payments made over the dues amounts listed will be credited towards future dues. Please retain receipts/cancelled checks of any payments made.

PAYMENT PLANS:

If you wish to be put on a Payment Plan, an agreement will be executed between resident and BOD to ensure compliance. It can be monthly or quarterly. A service charge of $10 will also be added to your monthly or quarterly payment.

Payment Plans will require a simple agreement signed between parties that will indicate payment schedules along with the notation that late payments will void agreement. It is understood failure to comply with payment of dues will result in collection and possible liens imposed.

MESSAGE FROM THE BOARD OF DIRECTORS

Our next regular BOD meeting is February 20, 2020 @ 11am.

Dear Resident,

The Board of Directors have expended innumerable hours researching and reviewing the financial status of the community from current records as well as some of those turned over by the prior administration. Our debt of approximately a half of million dollars far exceeds the possibility of paying down these costs with incoming dues, especially if we hope to have roadway repairs done.

Richard Henry, Esq. our association counsel, discussed Chapter 11 Bankruptcy and recommended this may be the best way to proceed due to the volume of creditors, the obvious lack of funds and the uncertainly of the scope of debt since we still have outstanding hard drives and records not submitted. You cannot meaningfully negotiate with each creditor individually without having Chapter 11 in place which will then allow PMLF to address all of our creditors in mass with a re-payment plan at PMLF's pace and as income begins to flow. The only other alternative is to invite state court suits out-numbering your funds which will probably force a bankruptcy eventually.

There are several pending lawsuits (Dime Bank & Hardy Collection Suit) on for February and asking for continuances makes little sense. PMLF does not have funds now and won't have any more in three months. Furthermore, matters like Hardy's complaint needs to be thoroughly investigated. Once in bankruptcy, the Dime Bank debt should be easier to address, again at our pace. The BOD unanimously moved to authorize Mr. Henry to coordinate with the bankruptcy attorney who we will retain (cost $12,000 which includes filing fees/court processing fees). Mr. Henry will also pursue the existing judgments against property owners since they are time-sensitive and we don't' want to lose any potential of judgment monies not being collected.

The BOD has also moved that the dues for 2019, 2020 and 2021 will be $602 for each year. This does not include past due prior to 2019 but receipt of these funds will help in assessing improvements that can be made this Spring. If you pay all three years in one check, you will receive a 10% reduction. Those residents that may have paid the $850 or $617 will have a credit towards future dues. The dues invoices will be sent out in the next few weeks. Anyone wishing to send these monies in now, please do so by mailing your check to PMLF, PO Box 1, Dingmans Ferry PA 18328 c/o John Swift, Treasurer. Checks are made payable to PMLF.

The Finance Committee have already met and will be working on the 2022 budget which we hope to have available within in the next few months. Other committees are also organizing. If you wish to be on any committee in our community, your help is needed. Please volunteer: send an email to Cheryl Schweiker at: cheryls@pmlfcommunity.com with your contact information and the committee you are interested in helping. Governing Doc committee and Grievance Committee are probably two of the most important committees that will help guide PMLF in the future. A list of the committees and their descriptions are listed on this website.

We feel these decisions made are the best possible avenue to take to address moving forward as a community. As always, your input is important to the community, and transparency in all operations is key. Thank you for always being ready to help and we hope with your continued help and support to be able to bring those changes we all want to fruition.

Dear Residents,
The Board of Directors was approached by the bus company after receiving complaints of the bus stop at gate 2 being unsafe. It was proposed to change the bus stop to Gate 1 for the safety of the children. However after seeing concerns of parents in Gate 2 the board has discussed maintaining the drop off area at Gate 2. The roads will be widened and we ask that all parents park single file on Fox so as to not block other traffic or the bus maneuvering to exit.

Community Resident Update

Dear Residents,
It's been a while since updating you on the status of things within our community, especially that of the much delayed election. By now all of you should have received their election mailings. The results of the election will be announced JANUARY 15, 2022 (Saturday). The Judge waived the 95 day requirement to 75 days to insure this date is adhered to, allowed all residents to cast one vote, even those in litigation with community or members in bad standing.

A 'Meet & Greet' with the candidates held November 7th brought out many new and old residents. Special thanks to Pat Morley and her husband for hosting this event which was well received by the residents attending interested in listening to plans on how the community could move forward. It' s our community so one should be free to question those that put in resumes on their backgrounds, experiences and the plans they envision for PMLF.

Don't forget to mail in your ballots before December 31st. If you DID NOT receive or LOST your ballot, contact Eric L. Hamill, Esq., 501 Broad Street, Milford PA 18337. Ballots are on special paper and cannot be duplicated or copied.

Snow removal is now under discussion, and it is hoped this will be solved before the snow hits. Several residents in our community have offered to plow for the community and will be paid $80/hr until our monies run out. Although we did receive proposals from outside snow contractor companies, the price was exorbitant ($77,000), far beyond our existing funds.

As many are aware, there is a logging operation commencing in Gate 1 under an approved State Forestry Permit. It should be noted that property owners are free to harvest subject to Local regulatory and Conservation plans. The area being harvested is owned by Pike County Land Development a private LLC. There are three primary areas to be worked: near Meyers, Lake Forest, and Wilderness. Operation will comply as follows:

  • Insure no conflict with hours of operation with school bus transportation coordinator
  • $10,000 Bond maintained by Forester for any damage of bridge/etc. to community
  • Protect and/or repair existing roadways being used for forestry as well as plowing if necessary
  • Safety signage along site to indicate to the travelling public logging operation in place - trucks entering/leaving.
  • Plan to protect existing roadways from further deterioration, and possible improvement.
  • Emergency contact numbers posted or on file.
  • Ribbons are on entrances for operation on Meyers, Lake Forest and Caribou. Additional signage and/or ribbons may be required as the plan matures. Trees to be removed have been marked. Trees being removed are primarily large oaks and hardwoods cutting to stumps roughly 6 inches above ground; no stump removal. Most topping cuts will remain on site to protect seedlings from deer as is custom.
  • Forester indicated that seed will be placed on disturbed soils as part of the State approved Erosion Plan. When restored, adds more wildlife habitat.

Some may have seen the temporary ramp that was constructed that was to be used for egress/access of logging trucks over bridge. Due to safety related items, this ramp has been totally removed. This permission is based on legal rights that were established at the time of the Association's founding. A detailed map of areas being forested is below. Although exempt from local laws and community regulations, the owners have agreed to work with the community to protect our residents and our properties We actually have very little to say as roadways are actually deeded easements to the captive properties.

Residents Meeting Postponed and Court Order

Dear Residents,

The residents community meeting has been rescheduled from this Sunday July 18th at 11:00 am to July 25th at 11:00 am at the clubhouse.

Today we received the executed Order from Judge Chelek calling for the election on December 4th at 10:00 am at the clubhouse. We are glad that we are finally moving onto the next step which was anticipated a year and a half ago.

Please read the order and to those that are interested in submitting a resume for one of the five open seats, please begin your quest and following the instructions indicated in the Order. We hope any of you interested in seeking a board position will band together to make sure only the best qualified candidates are chosen.

We are still anticipating further instructions from the Court relative to interim operations. We have offered numerous comments on day to day operations and how they should continue.

We will continue to hold community resident forums and will notify you when these dates are set.

We thank all of you for your patience during this difficult period and especially appreciate all those residents that have supportive and volunteered their time and energy to our community.

Once again PMLF has been contacted by yet another forester for tree cutting on properties off Meyers/Wilderness/Lake Forest. You may recall this came up a few years ago with a different agent. Apparently they are again looking to move forward with tree cutting on their properties.

BOD Resignation

We recently received Don Hiorth's email resignation. We thank Don for his time working to help heal our community. We were unwilling to send out invoices as discussed at the residents meeting which differed from Don's feeling. We hope Don continues to work on the various committees that are so important to the future of PMLF especially the By Law Committee.

RESPONSE TO LARRY FLOSS E-MAIL

It's clear from Mr. Floss' message that he still misses the whole point - This is a Community with real questions and concerns.

It doesn't mean that we have only one thought from the anointed one. We build by community consensus not by dictates.

The risk to community monies was in a warning to the Board in 2015 - this in the Auditor's report to the then Board that cash and payroll were running too freely - and so it did. Unsupervised employees, problems with the pool deferred, money for repairs never allocated, unpaid trash haulers (compactor) heavy trucks, selling equipment and snow removal on poor pavement all without discussion at a GMM where people have real input.

There is indeed a great deal to be discussed with the membership. Particularly, why are we in litigation still or even at all. Who authorized the activity and how? - I don't think it made the agenda at the GMM or a SMM. How long have we been manipulated just this way?

The Posting from Floss represents the same tired story line as what got this community into the mess it is.

Take no responsibility, speak in vague innuendo, present no facts, give no-one enough information to think things through the process themselves. Most of all don't look at the big picture - there has not been any issue other than an true Open Election in most of these legal actions - Why do you spend so much in community resources TIME and Money to deprive them of what they are entitled to.

This Community is ready and able to recover any time you and Anders are ready to take the foot off the brakes.

PMLF Financials

Keeping our promise of full transparency, both sets of financial documents submitted to the Judge from both parties are posted for your review. The financials are a living document with deposits, checks issued and clearing daily. The document we are using (and submitted to the Court) is the regular extraction from the account (Bank Data) enhanced with the detail as to whom and for what. It covers everything from when the account was opened in March of 2019. We do not have an Association Credit or Debit Card to avoid the casual transactions that get so many into trouble.

Court Update

The Court hearing did not produce a final product, but did indicate that the priority is that of implementing a new (supervised) election. It looks that every member will be permitted to vote without exception obviously limiting to one for each houshold (or max 3 Lots). The timetable and specifics will be directed by the court to facilitate the activity.

The order is expected to be issued inside of a week.

Gate 2 School Bus - Relocation for pickup and dropoff

Due to the poor maintenance of the roads over the last decade of mismanagement has created a problem for the school buses in Gate 2. Lake Forest Road is wash boarding, a phenomenon in which the road surface is malformed into ribbles similar to an old fashioned washboard. This is common in dirt and stone roads, and even on asphalt and concrete roads where heavy truck usage is frequent.

Unfortunately the school buses will no longer go to the normal bus stop due to the road condition and as of this coming Monday March 8, the school bus stop will be moved to the entrance to Gate 2 on Silver Lake Rd. The BoD regrets this situation and hope on March 23 when we have the next meeting that the court will bring an end to this insanity. Keep your fingers crossed.

SNOW UPDATE

Good morning PMLF Residents,

With another weather event on the horizon, we're providing this information to all residents for clarity. We want to ensure that your issues, concerns and complaints are dealt with in a timely fashion, while at the same time not giving any credence to trouble makers, pot stirrers or antagonists. As mentioned in the past, the BOD does not use Facebook and if posts are put on that site they will be missed since these social media sites are not an official outlet for the Board. Anyone who posts on there, posts as a community resident, with his/her own opinions and ideas (the very nature of Facebook) and not in an official capacity, unless the heading states "Official PMLF Business" and is from a Board member or Committee chairperson.

Further, just to make sure all in the community understands that the methodology for maintaining our roads during a weather event which haven't changed in years is always to make sure that roads were cleared "enough" for emergency vehicles to traverse through the community. With final "clean up" being completed after the event is over. The standing rule was/is to plow, as needed, all main thoroughfares within the community and treat ALL hills, curves and trouble spots (such as ice buildup, etc), as well as the parking lot, then move to do the same for all secondary and tertiary roads. The only change to this directive, is that the roads must be opened for those that have registered their address due to medical problems like chemo, dialysis etc.

With all of that said, let's talk about some areas of the community. Meyers Rd, Fox, Seneca Rd, Lake Forest Rd, , Country Club Road and the bus stop areas are just a few of the main thoroughfares, as well as Willow Dell and several other areas where steep or icing problems are historical. All other roads, albeit, side streets, dead ends, and cul-de-sacs are considered secondary and tertiary roads/areas.

Now, let's talk about weather in the Poconos. Some of you have lived here for, at least 5+ years or longer, others are relatively new. If you are looking for roads maintained like NJDOT, you moved to the wrong area. Their budget is bigger than ours, end of story. Power outages, occur and can happen frequently or for extended periods of time in this area. Be prepared for this. However, many of us, if made aware, are willing to get together and lend a hand if needed. Whether it's getting fuel to you, heaters, food, etc. Finally, please remember these simple reminders during all adverse weather events:

  • DO NOT park anything on our roads or our shoulders. REMOVE your garbage cans from the side of the road. Our contractor will not to protect your cans. If they are damaged, or lost, that will be the homeowners responsibility.
  • DO NOT plow, shovel or snow blow your snow from your property onto our roads, especially if the contractor has already plowed. We've received some complaints from neighbors about their neighbors doing exactly this.
  • DO NOT ask the contractor to plow your driveway. Our contract explicitly states that he works for the Board to maintain PMLF roads, not for your individual/personal plowing/snow removal needs.
  • DO NOT stop the contractor from performing his/her duties, PERIOD. The contractor isn't here for your advice, suggestions, complaints or nonsense. PREPARE. As with any event, we could suffer power outages, large snowfall/ice amounts.
  • Have enough food/water on hand for at least 3-7 days. Have a means for alternative heating and/or a generator, if you can. DRIVE with caution, keep your speed to 20 MPH or lower, as posted. Have good quality tires for the winter on your vehicle.

MESSAGE FROM THE BOD

Dear Resident,

We all hoped Mother Nature would be kind to us. She wasn't. This storm will eat up a healthy chunk of our financial resources. With more still coming, it may be that we won't have enough cash reserves to cover to the end of the winter. If those residents who did not pay the $617 dues invoice for 2018-2019 would voluntarily pay their long overdue dues it would get us through the winter. Despite the doubt from some people, we can fix this community. Look what we've managed to do without collecting dues for two years. But it will require a five year master plan on all elements of the community addressing each component yearly with budget while we rebuild our credit to allow bonds/loans (we have no credit rating at all). It can be done but not tomorrow.

Everybody know the roads are a priority. Coupled with that is the necessary drainage master plan upgrades. We have three residents serving each gate as Gate Leader with other volunteer residents who help in each gate working with them. There are minutes and reports on the website that give lots of information. ZOOM BOD meetings are held every third Sunday at 11am and ALL are encourage to attend. Meetings are opened to all residents for you to ask questions or make comments. The link for these meetings is sent by email to our distribution list, is posted on our website and on social media. If you are not getting our emails, then send an email to office@pmlfcommunity.com and we will get you on the email distribution list.

What's past is just that the past and as bad as it was, let's just forge ahead together because unless we all agree 'what' we want and find ways to get it, we won't move forward.

SNOW UPDATE

Dear Resident,

Obviously, a whole lot of people are upset about the current situation. Some people are actually in danger because of medical conditions. Yes, things are a mess

But before bringing the membership up to date on the current status of snow plowing, we needed to get all the current facts . The contractor we hired was the same one who worked for us last year ,and in the last snow storm, More importantly, he was the only company willing at the time who was willing to work for PMLF. He has two trucks, both developed engine problems while plowing on Monday. One of the trucks in repaired and has been out since six this morning on Seneca Road. The other truck will be fixed by mid day and this truck will be out plowing also. We hired another snow contractor who is also over at Seneca. We are talking with one other snow contractor to bring on to make sure all of the roads are done.

Right now the intention is to focus on all of the main corridors, and then will return to secondary roadways. We are aware of health issues that some residents have and those need to be addressed. Those who gave us their street roads who are concerned about getting out due to problems (dialysis/chemo/etc.) , these secondary roads will be hit first. If you have a serious health problem that needs immediate attention send an email to office at office@pmlfcommunity.com and we will put it on the list of streets to prioritize.

As to our truck, one of our residents is now down at garage trying to see if we can get wiring addressed to allow that truck to be used. If so, this will be utilized. Yes this storm WILL eat up the reserve of cash that we have and it may be we will need to address that in immediate future with all of you. Right now, we doubt he have enough money to do plowing through the end of this winter.

We have contacted over 20 plowing contractors: Some are already busy plowing other communities. Some refuse to do business with PMLF because they didn't get paid when they did work for us in the past.

We will not stop from continuing to look for additional plows but as stated above, slim and far between. Little trucks with plows WILL not move this amount of snow. Yes there should had been a back up plan not anticipating three trucks down simultaneously, but all that has been humanly possible has been done and will continue to be done. This is the most current news and we will continue to post as the day goes forward. Thank you all for understanding and although not happy know we are exerting every ounce of our energy towards resolution of this snow removal matter.

Snow Storm 1/31 - 2/1

Dear Resident:
A snowy winter is a child's dream. What's more fun than the chance to build snowmen, dominate in snowball fights and of course, relish in the pure joy that is a snow day? Oh, to be young, blissful and mostly ignorant of the havoc wreaked by major winter weather. But for all of us, the prospect of a snow event is regarded with dread. Frosty the Snowman becomes a sinister sign of impending mayhem, especially for your board who are responsible for keeping residents safe from snow and ice. The key is preparedness. As many are aware, we have provided snow removal and ice coverage these past three winters. Preparing for this next nor'easter we ordered and have in our maintenance shed another tandem load of salt/grit mix. We try the best we can to mitigate risks associated with weather conditions for residents and visitors and have been proactively addressing safety measures as best we can. There are two plow trucks fueled up, serviced and ready to go.

We are in constant contact with our snow contractor during the storm, so if there is an area or something that needs to be addressed, best method of communication to the BOD is to send a note to our email address: office@pmlfcommunity.com. It's imperative for our residents to maintain an open line of communication with us so we can address areas needing resolution. If there is anything on the streets, cars, boats or storage items, please remove them so there is a clear path for the plows. There are some areas where cars are left in ROW's and plows have to go around them causing more difficulty to all. Let's hope Mom Nature treats us kindly. Stay home if able. Watch out for your senior neighbors. Don't forget to fill up your gasoline containers for your generators, install new batteries in your flashlights. A good hint: water softner salt is cheaper (at Lowe's etc.) than buying salt crystals so if you need de-icing, consider cheap alternative. Put water in bathtubs should electricity go out for flushing or bottled water drinking. At this time, there are no plans to open clubhouse but if needed we will consider opening for heat/flushing water.

Stay safe, warm and cozy and remember: spring is only 52 days away.

NOTICE TO SCHOOL BUS PARENTS GATE 2

A short time ago the BOD paid for two truckloads of material most of which was used to bring Lake Forest back into a drivable condition. A group of our residents got together and used this material to repair Lake Forest Road from Gate 2 to the school bus stop to make things safer for our children getting on and off the bus. It's been said, but it bears repeating.... Thank You All for volunteering your time to do this.

Unfortunately, due to the snowstorms, ice storm and rain, and speeding a lot of the gravel has come out due mostly because of the inadequate base, years of neglect and the poor drainage in Gate 2, all of which have taken their toll, and the same problems are reappearing. The tonguein-cheek definition of insanity is doing the same thing and expecting a different outcome. That is where we are on Lake Forest Road. Since we cannot bill for dues because of the ongoing court settlement, we are concerned about shortage of money. It just doesn't make financial sense to put any more significant funding into more repairs that we already have proven to ourselves won't last. Especially with the limited funding available to keep the roads clear of snow. The BoD believes that at this point we need a contractor with the right equipment to work on this road. We can put together the plans on what to do and who to do it, and when we finally start collecting dues we can get the funding to make it happen. But until then we all have to live with the reality of a bad situation. No one wants to hear this, but you can't solve a problem until you admit it exists. We need to admit we just can't fix this ourselves and are meeting with contractors to see what can be done to this roadway.

If there are parents that have children using this bus route, perhaps a network of these parents can be coordinated to make sure any large craters are filled from materials deposited for this use. The BoD agreed to get one last delivery of gravel to be placed at the corner of Raccoon which was delivered already. As noted there is little money left and what is remaining is earmarked for snow coverage. Your help is needed if you want this bus route to remain intact. Who will take the lead in forming this crew so that the bus can continue to come into the community? Without the cooperation of volunteers we are at the risk of losing our bus stop and having it moved back to Silver Lake as early as this coming Monday January 25th. We all must do our part for the safety of our children! Please write office@pmlfcommunity.com and let us know who will assist in making sure this bus stop remains inside gate 2. We need this information quickly and to have this organized for the weekend approaching since school transportation coordinator has already written PMLF on need to fill potholes.

Court Appeal Decision - SUCCESS!!!

The Appeal decision has been issued. Chelak's Jan 31 court order has been AFFIRMED. That means Floss and Mall are by court decision NOT on the BoD and by implication of the discussion section of the court order....NEVER WERE ON THE BoD. Their false claims will be an issue for the real BoD to discuss. There remains the issue of the election. The Directors think that the election we held in Oct will be accepted by Judge Chelak once our documentation is presented, but we recognize there is a chance Chelak will order a new election. If that happens so be it; there is nothing wrong with the membership having another opportunity to make their preferences clear. In that case we will ask for either permission to continue spending money on plowing or a court appointed overseer to make plowing happen during the election process. The BoD will make every effort to ensure that the roads, such as they are, will be plowed and salted as weather dictates If our election is upheld, we will start collecting dues, if there is a new election the new BoD will do so. That is what has to happen to start fixing the roads. More will come out on that. And whether it is this BoD or a new one, GET INVOLVED. Many do not trust the BoD because of what our predecessors did. GOOD! Don't trust. VERIFY. Sit in on the monthly BoD meetings on Zoom. Ask questions. Demand answers. As Lee Iacocca used to say when he was fixing a broken Chrysler Corp. "IF YOU'RE NOT PART OF THE SOLUTION, THEN YOU'RE PART OF THE PROBLEM".

ATV's, Quads and other such vehicles

  1. All unlicensed vehicles are forbidden on Association streets by the restrictive covenants on each of our deeds which were place there in 1972 when the Association was founded
  2. Insurance companies are against them in associations.
  3. Non-licensed vehicles of any kind ( including old cars) are forbidden by the 2001 Rules and Regulations document( para. 10.1, pg 5)

There has been a lack of enforcement of the rules on these vehicles. However, their use has become rampant in the last few years. The problem is that a few people have used them in an irresponsible manner, arguably disturbing the peace, arguably creating a nuisance, both of which violate the Rules and Regulations ( and ruining things for those who do use them responsibly. The blatant disregard for others has become so bad that a neighboring community recently contacted us complaining about people, presumably from PMLF, trespassing on their property and creating a nuisance.

We recognize that living where we do facilitates the recreational use of quads, ATVs and the like and some members want them. We also are well aware that the rules have not been enforced for a long time. But as a community we need to balance the desires of everybody, not just ignore or enforce a ban. This requires a compromise, and a good comprise is one in which nobody "wins" and so nobody is completely happy with the result.

To that end, it is not our current plan to strictly enforce these rules. We are not going to hire traffic police. We do ask that everybody start being considerate of their neighbors. Keep these vehicles off our roads. Their only place is on tracks in woods on public land. At some point it may become necessary to take further steps and start fining people in response to complaints. But we would much rather not have to go there.

Board of Directors Appointments

Recently an election was held and 4 people were elected to the BoD. State law requires a minimum of 3, so from that point of view the association has met the minimum requirement.

But, our bylaws call for 9 members serving for 3 year terms in a 3 year rotation. That means we elect directors each year providing for a rotation of members who serve on the BoD and in theory a mix of old members and new members. The objective is to prevent anyone from becoming a permanent fixture and gaining too much power, and to provide a guaranteed opportunity for people dissatisfied with the way to Association is being run to have a real opportunity to implement change.

In the past decade we have seen the weakness in the way the bylaws were written that was use by a few to take over and turn the community into a dictatorship. We need to make some bylaw changes. Bylaws changes, done properly, take time, careful thought and a GMM vote by people who have been educated on what the proposed changes are and have had time to carefully think about those proposed changes.

While we repeatedly asked for people to run for the BoD prior to the last election, we did not receive any additional resumes before the submission deadline. To preserve the integrity of the election process and prevent future legal challenges to it we strictly enforced the submission deadline. But we did receive 4 resumes after the submission deadline.

The Bylaws provide for a specific process to fill vacancies. On our website on the left side menu, fifth item down is a link to our bylaws. Article VI, Section 1, Paragraph D 3 and D 4 detail the legal process, which each of you can read the requirements for yourselves. We urge you to do so, the more members know what the rules are, the safer the membership is. Item 3 relates to filling board seats after an elected director has left the BoD, item 4 deals with filling seats that no one was elected to, by appointment to a term on the board that ends at the next Fall GMM. We believe that this needs to be done. Four people can not properly run this community, and one thing the membership has made clear, they wish to return to proper management of the community. Additionally, the long established method of preventing too much power in too few hands is to have power permanently distributed among more people. It is definitely not in the best interest of the community to have only 4 people on the BoD.

After a lengthy discussion on the resumes received after the deadline date, the Board found it is in the best interests of the community to appoint new blood to the board feeling it would be better for the community to have individuals that would bring fresh new ideas and experiences that will help promoting goals of change for our community. We therefore wish to announce the appointment of Ms Janet Wexler and Ms Cheryl Schweiker to the BoD. Each will serve until the GMM next fall at which time their seats will be up for election.

We still need more volunteers to fill the remaining 3 seats. What allowed a few to take over and run the community into the ground was too much power in too few hands, we urge people who want to see the community return to being a great and desirable place to live that now is your chance to help make that happen.

Road Committee volunteers

Regarding the roads situation; The BoDs current intention is as follows. We will establish a functional Road Committee. The purpose of that Road committee is NOT to go out and fill potholes. Rather, the committee will look at all the roads and put together an assessment of what roads need to be repaired soonest, prioritized by usage and safety factors. This info will be used to put together a Road Plan that the membership can review and comment on at the Spring GMM. That will give us enough time to award a contract so we can get started sometime in May.

To ensure fairness we need one or two people from each Gate to serve on the committee. We have people from Gates 1 and 3. We still need someone from Gate to volunteer to join this committee. Let's be realistic, everybody will want their road paved first, and we just do not have the money to pave all 26 miles of roads. So we have to fairly distribute the money between the three gates, and the best way to do that is to ensure that a representative from each gate has a voice in formulating the roadwork plan. So, would someone from Gate two please step up and help us formulate the plans to start solving the road problems we all are so unhappy about? PMLF Past Dues

To the members of PMLF.
Yes you elected directors in the first honest election in many years. Yes you passed a budget that allows us to collect past dues. The first steps toward restoring the community have been taken.

In what we think is good news, the defendants in Floss's suit have received a letter which states that the appeal will be considered considered on Dec 7 (tentatively) and hopefully a decision announced shortly thereafter. Experience says that we probably should not consider that date as set in concrete, but it means that the appeal is progressing through the system....FINALLY.

Based on this new information the newly elected BoD thinks it may be better to delay billing for dues payments until after the appeal decision is announced. We think we can squeak by as long as the weather in Nov and Dec is not abnormal. By not collecting dues no one can be falsely accused of mishandling funds.

If people wish to pay their dues prior to then, we will, gratefully, accept voluntary dues payments to help ensure that we don't run out of money if there is heavy early snow or ice. But we will refrain from sending out dues bills and you will not be considered late or suffer any penalty if you choose to wait on paying your dues until those bills are sent.

No, this is not normal. Nothing has been normal for a long time. But it is only fair to those people who took an enormous financial risk in Nov 2018 to rescue this community to not put them at further risk.

If the appeal decision is announced in Dec we expect to finally be free from the disaster caused by a decade of mismanagement. Maybe we can really get back to what the Association is supposed to be doing.

Summary on discussions with paving companies

October 13, 2020

IBoD members have had discussions with two paving companies for information purposes only related to budgeting at this point. No promises have been made to anyone. This info is being publicized so the membership understands what we have been told so far and in keeping with our pledge to be open with information.
  1. We had a meeting with a company that does stone road construction and maintenance and asphalt paving ( no tar and chip)
    1. It was recommended that we go with tar and chip because asphalt was too expensive and because proper maintenance on stone roads ( main traffic roads: Fox, Lake Forest, Seneca, Myers/Willow Dell, Bus Route roadway, Country Club Rd. and parking lot areas up to Beach Rd) would be very expensive. Maintenance of stone roads on less traveled roads would be significantly less expensive.
    2. It is not possible to pave roads and keep them from rapidly deteriorating unless we either excavate existing road to a much deeper depth or add several inches to road bed material to the existing roads to raise the road bed above the surrounding land. The problem is drainage.
    3. Besides the drainage issues, vehicular weight is the primary factor in road surface degradation
  2. We had a meeting with a company that does tar and chip as well as asphalt and stone.
    1. This company also recommended tar and chip. They have done work here in the past and do extensive tar and chip paving for several other associations in Pike County
    2. They recommend a minimum of two coats applied at the same time.
    3. They also recommended raising the existing road bed at least two inches above the surrounding land to get better drainage.
    4. They specifically cited garbage trucks and propane tucks as responsible for much of the damage to the paved surfaces. Weight is what destroys roads.
    5. Rough order of magnitude pricing for the paving ( not including raising the road bed) is about $25k for a half mile, and about $48k for a mile. The mile length is around a 4-5 percent discount compared to two half miles. These are NOT quotes, just budgetary figures for discussion purposes. We should probably add 40 to 50 percent to that figure for raising the road beds on a one time basis

Warning About Illegal Collection of Dues

It has been reported that someone is knocking on the doors of new residents falsely claiming to represent PMLF and demanding dues payment. The IBoD wishes to remind everyone that no one should be collecting dues per the Jan 31 court order. Whoever attempts to collect dues prior to he October's GMM has no authorization or legal basis to do so, nor has an legal basis for "retaliatory action". Any effort to collect dues prior to the GMM is fraudulent. So, if it should happen, we suggest simply closing the door. If you have a new neighbor, do them a favor and let them know.

Transfer Fees

The IBOD has received emails regarding transfer fees when a particular lot or home is sold. Below is stated within our bylaws.

Article V, Section 4 Paragraph G:
A transfer fee of 100% of the prior year's dues for an improved lot or 50% of the prior year's dues for an unimproved lot shall be collected at the time a recorded owner of a lot is changed. This fee shall be placed in a segregated account to be used for capital improvements. The statute does not state who pays the fee, however the new owner is not a member in good standing until the fee is paid.

Answers to questions regarding PMLF 2020 Election

To our PMLF Members: Time is running out to submit resumes for inclusion on ballots for the GMM. It is apparent that there are many questions regarding the legality of conducting a General Meeting and electing a Board of Directors and Adoption of Budget. As I agreed to be Election Chair, I will tell you why I agreed to volunteer and give my time and energy to this Community.

On Nov. 25, 2018, I witnessed the debacle of the election results presented. We were given results of Election from a paid CPA that was hired by Floss, et al. We were not able to receive a listing of residents that received the ballots (was advised that many did not receive one) or view the returned ballots to make sure that they were validated. We then found that the records that were held were incomplete so we questioned how they were able to mail to all residents in "good standing"? There is simply no way that all eligible voters were sent a ballot for a number of years, hence no way that any election held can be considered to have been fair, honest or legal and for this reason I offered my professional expertise to make sure any election held in the future is done 100% accurately. I won't allow anything less!

At the December 2019 Meeting (minutes on Website) this was discussed with all members present and they voted unanimously to elect myself as Election Chair to run the Election for upcoming meeting. This was prior to the Judge's January ruling and subsequent appeal. In fact, when the Judge ruled that he wanted to appoint someone to conduct the meeting, our attorney (Henry) submitted my resume to the Judge. However, at that point the appeal was implemented.

Mr. Henry is the Association Attorney. However, as an officer of the Court, Mr. Henry cannot advise us to work around a court order let alone one tied to an appeal. We are moving forward solely based on the reliance of our Bylaws which call for a fall election and on PA Law Title 68 which requires that a HoA operate in accordance with the bylaws.

We have now seen various inquiries and suggestions as to how to proceed. Collect donations for snow plowing, to fix roads, have been reviewed. Insurance needs to be paid as well. But the question remains...who will account for the collected money and keep track so that it can be applied to dues (when all is resolved)?

We all want to see an ending to this debacle. At least you will have a BOD that will be fully accountable for any monies, dues, etc. received and will be able to sign a contract for snow removal and start getting quotes from contractors for road repairs.

These are all reasons why we must move forward than continue to be held hostage by court actions. What is the worst that can happen? The Judge claiming it was illegal? So we start all over. If we sit back and wait, we continue to be hostages so it's time to act. The GMM of October 18th is not that far away so your help in making the community whole again is needed.

Pocono Mountain Lake Forest - Election 2020

Dear Residents,

Due to the appeal filed by Mr. Floss et al on the Judge's decision, there is no one overseeing PMLF: anyone collecting dues, paying vendors, fixing roads or contracting with outside vendors for snow removal this winter season which is usually finalized by October. Since we are basically on our 'own' and to restore management to our community, it has been decided to proceed with an Election to elect new Board members as well as approve a budget for 2020-2021. The GMM (General Membership Meeting) of October 18, 2020 @ 11am in the Clubhouse has been set and previously noticed for adoption of budget and election. The concern facing us is without a Board of Directors appointed and in place before the snow season, it may be necessary for each homeowner to hire their own personal snow plowing company to provide snow plowing services which none of us want to see happen.

Dear Neighbor:

Recently Mr. Floss and others sent you a letter claiming to be the president of PMLF asking people to send him money under the premise it was for dues. It is our belief, based on Association records that Mr. Floss is NOT in any way associated with the administration of the community since not only was he legally removed in February of 2017, we also feel they are violating the intent of the Judgment which asked both parties to cease and desist any activities. Court Decision - PMLF

February 5, 2020

Dear Resident: The judge has released his court decision and resultant court order. The resultant court order that affects PMLF as of today and for our future is as follows:

  • Floss's requested injunction was denied, and the judge stated it is unclear that Floss and Mall were ever properly elected to begin with.
  • There will be a future meeting, not a public one, to examine financial records and reconcile everything into a single association wide record, thus ensuring that dues payments to Mr. Floss will be counted as dues paid to the Association. If you paid Mr. Floss you will most likely need to bring proof of that payment to the Association, but by court order no one who can show proof of payment will get double billed for last year's dues.
  • The court will supervise the upcoming election. None of the current IBOD members will carry over, all seats are open. Any member in good standing can stand for election to the BoD. The date of this election is as yet undetermined.
  • Next years bills for dues will not go out until after the election is held.

The members of the IBOD view this as an excellent result. Thank you to all those who supported the effort for the membership to take back control of the Association. The best way to change things is for each of us to act to make a difference and many of you did just that.
